These Terms and Conditions (“TC”) set forth the terms and conditions required for the use of DTrusted.com.ng (“The Site”).The terms and conditions stated or referenced herein constitute a legal agreement between you and DTrusted. By using or receiving any Services, or downloading, installing or using any Applications, you hereby expressly acknowledge and agree to be bound by the terms and conditions contained herein, and any future amendments and additions to these TC as published from time to time at https://dtrusted.com.ng or through our Services. Upon such using or receiving our Services or Applications you become a “Member” of DTrusted’s Services and Applications, whether as a “Shopper” or a “Traveller“ or both, as further described to as such herein.
In addition to the TC set forth herein, both Shoppers and Travellers are subject to and must abide by the DTrusted’s Membership Agreement (“MA”) found here. DTrusted reserves the right to modify the terms and conditions of these TC or any of its policies relating to our Services or Applications at any time, effective upon posting of an updated version of the TC on our website DTrusted.com.ng, the Services or Applications. You are responsible for regularly reviewing these places for any updates to the TC. Continuous use of our Services or Applications after any updates shall constitute your consent to such all changes to the TC contained in such update.
Our Services To Shoppers and Travellers
Our Applications and Services make it possible for those individuals and/or businesses that want to contract with DTrusted to shop and deliver items to them (“Shoppers“) and those individuals and/or businesses seeking to execute the shopping and delivery tasks requested by our Shoppers (“Travellers“). The performance of a shopping and delivery task by a Traveller, the time period in which this task is performed, as well as the item(s) shopped for by a Traveller, are collectively referred to as a “Shopping Request”. Travellers and Shoppers together are referred to as “Members“.
Travellers and Shoppers Screening
DTRUSTED MAY NOT CONDUCT SCREENING OR BACKGROUND CHECKS OF ANY MEMBER FOR THE PURPOSES OF ALLOWING THEM TO USE OUR APPLICATIONS OR SERVICES, HOWEVER DTRUSTED AT ALL TIMES RESERVES THE RIGHT TO DO SO IN THE EVENT OF A FRAUD CASE OR SIMPLY TO ALLOW MEMBERS GAIN FULL ACCESS TO OUR PLATFORM. MEMBERS ARE REQUIRED TO BE VALIDLY REGISTERED AND SUBMIT RIGHT INFORMATION.
DTrusted may not conduct any background checks or screening processes either before a Member can register for our Services or during use of our Services. We may not investigate or verify any Member’s reputation, conduct, morality, or criminal background when acting as a Traveller.
Notwithstanding the above, DTrusted reserves the right to conduct such checks and screening of Members at any time as it deems appropriate in its sole discretion, including but not limited to verification of identities, criminal and other background checks (at the Country, State and local level as we deem necessary or appropriate). DTrusted also reserves all rights to use such third party services to run such checks and processes as we deem appropriate in our sole discretion. In addition, DTrusted may and reserves the right to verify any information Members may submit to us during registration and/or continuous use of our platform.
By registering and using the Services or the Applications, each Member acting as a Traveller consents to DTrusted conducting one or multiple screening process(es) and/or background check(s) on such Member or other Members that DTrusted deems advisable or necessary, and as otherwise may be required for compliance with federal and state laws and the Anti-Money Laundry Act.
Restrictions on Locally or Internationally Prohibited Items
When making a Shopping Request, a Shopper must not include and no Traveller may knowingly accept any Shopping Request containing any “Locally or Internationally Prohibited Item”.
Prohibited Conduct
When making a Shopping Request, a Shopper must not include and no Traveller may knowingly accept any Shopping Request containing any “Locally or Internationally Prohibited Item”.
By accessing, or using the DTrusted Platform in any form, You agree not to undertake the following:
Use another person’s Account, to misrepresent yourself, Your identity or qualifications or transactions;
Violate any federal, state, local, national or international law, or any rule, regulation, tariff or duty, including customs laws or regulations that may apply to You or to Your relationship with other Members or to any DTrusted Items.
Use any automated system including but not limited to robots, spiders, offline readers, crawlers, scrapers to access, copy, maintain or compile the DTrusted Platform or content thereon for any purpose without seeking DTrusted’s consent;
In any manual or automated way copy, appropriate, use or disclose any copyrighted text, or other intellectual property, rights of publicity, privacy or contract rights or otherwise misuse or misappropriate DTrusted’s information or content including but not limited to, use on a mirrored, competitive, or third-party site;
Take any action that (i) may unreasonably encumber the DTrusted’s infrastructure; (ii) interferes or attempts to interfere with the proper working of the Platform or any third-party participation; (iii) bypasses measures that are used to prevent or restrict access to the DTrusted Platform; (iv) circumvents, disables or otherwise interferes with security features of the DTrusted Platform; (v) distributes viruses or any other technologies that may harm DTrusted or its users; (vi) uses the DTrusted Platform in a way that violates any copyrights, trade secrets, or other rights of any third party, including privacy or publicity rights; or (vii) circumvents or manipulates and fees, fee structure or billing claimed or owed as a result of interaction, relationships or transactions that may be facilitated on the DTrusted Platform;
As a Member, use the DTrusted Platform in any manner that circumvents Your obligation to pay DTrusted for shopping and delivery services;
“Stalk,” or harass or intimidate any other Member or user of the DTrusted Platform; or collect, harvest or publish any personally identifiable data including but not limited to account information, from the DTrusted Platform, or use the communication systems provided by the DTrusted Platform for any reason not explicitly authorized by these Terms, including but not limited to commercial solicitation purposes;
Recruit, solicit, or contact in any form Members for any other use not specifically intended by the DTrusted Platform;
Take any inappropriate or unlawful actions, including the submission of inappropriate or unlawful content to the DTrusted Platform, including without limitation content that is hateful, illegal, profane, obscene, defamatory, threatening, or discriminatory, or that advocates, promotes, or encourages inappropriate activity, conduct that would be considered a criminal offense, or conduct that would give rise to civil liability or violate any law;
Violate any DTrusted policies that govern or relate to Your continuous use of the DTrusted Platform and interactions with You and third parties;
Registering for more than one (1) DTrusted Account or registering for a DTrusted Account on behalf of an individual other than Yourself or transferring or purporting to transfer your DTrusted Account to any other person.
Undertake any activity or engage in any conduct that is inconsistent with the business or purpose of the DTrusted Platform.
Fees
The following shall constitute the components that make up the Total Fees chargeable to the Shopper for any shopping request placed on DTrusted Platform.
(i) Item Cost: While a Shopper may specify a price in the shopping request, the actual Item Cost shall be the amount to be incurred in getting the item;
(ii) Traveller’s Reward: The Traveller’s Reward also known as Traveller’s Fee is the amount receivable by a Traveller for rendering shopping and delivery task.
(iii) Shipping Fee: This is the amount payable to DTrusted by Shoppers for shopping and delivery services for items/package exceeding the specifications for FREE Shipping. FREE Shipping terminates in Lagos Nigeria.
(iv) Clearing or Custom Fee: Amount payable by the Shopper for clearing imported items.
(v) Funds Transfer Charge: This is the cost of transfering funds from Shoppers and Travellers to DTrusted and vice versal. This charge shall be billed to recipient of funds which could be the Shopper or the Traveller or both for both inflow and outflow.
Shopper’s Acceptance of Item(s)
When the Shopper and DTrusted have agreed to all aspects, including applicable timing and Fees, the Shopper must agree to the Purchase terms and as communicated by DTrusted, in what we call the “Shopper’s Acceptance.” The Shopper’s Acceptance is an agreement on all material terms between a Shopper and DTrusted, under which the Shopper agrees to be bound to DTrusted.
Ownership, Acceptance, Risk of Loss – Traveller
Members acknowledge and agree that except where prohibited by applicable law or otherwise agreed to by DTrusted, it is the Travellers, and not Shoppers nor DTrusted, who own the Items and must be responsible for the presentation of all original receipts evidencing such ownership. Travellers also acknowledge and agree that to the maximum extent allowed by law, the risk of loss remains with the Traveller unless and until the Traveller has completed all of the obligations under his or her agreement with the DTrusted, which includes bringing the items as agreed.
Rejection and Refunds
Shoppers may refuse to accept the item(s) only if the DTrusted has brought incorrect goods (for example, specifications which differ from the agreement with the Shopper, in terms of brand, in terms of quality etc.) or the condition of the item(s) is other than that agreed to between the parties (for example, damaged or used items or otherwise not in the condition represented). Shoppers may not refuse acceptance of item(s) because they changed their mind about the transaction, or through an attempt to renegotiate the price of the items or because they have found the items elsewhere. Shoppers agree that DTrusted, in its sole discretion, may determine whether the reason for rejection is acceptable under applicable policies and if DTrusted determines the rejection is impermissible or unauthorized. In instances where the Shopper fails to appear for collection within seven (7) days of the communicated collection date, Items shall be deemed forfeited by the Shopper and DTrusted shall not be held accountable for such item(s).
NEITHER DTRUSTED NOR ITS AFFILIATES OR LICENSORS IS RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY MEMBER OF OUR SERVICES OR APPLICATIONS AND DTRUSTED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES AND LICENSORS ARE NOT BE LIABLE FOR ANY LOSS, CLAIM, INJURY OR DAMAGE ARISING IN CONNECTION WITH YOUR USE OF THE SERVICES OR THE APPLICATIONS. BY USING THE SERVICES OR APPLICATIONS YOU THEREBY RELEASE DTRUSTED, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES AND LICENSORS FROM ANY LIABILITY RELATED TO ANY USE OF OUR SERVICES, APPLICATIONS OR THE CONDUCT OR MISCONDUCT OF A MEMBER.
